Personal Use: You agree to use the Services for your personal use. Your commercial use is limited to transactions done on your own behalf. Solar Installation professionals may provide information to consumers via the Services or, where authorized, take actions on behalf of a consumer client (e.g., request a quote). You agree not to reproduce, modify, distribute, decompile, disassemble or reverse engineer any portion of the Services.

Restrictions to Use:

• Acceptable Use: You agree not to use the Services in any way that is unlawful, or harms RoofRay, its service providers, suppliers or any other user. You agree not to use the Services in any way that breaches any policy or notice on the Services. You agree not to alter or modify any part of the Website, including but not limited to RoofRay's Embeddable Widget or any of its related technologies.
• Automated Queries: These Terms of Use do not provide you a license to use, reproduce, distribute, display or provide access to any portion of the Services on third-party Web sites. Nonetheless, publicly available search engines and similar Internet navigation tools ("Search Engines") may query the Services and provide an index with links to the Services' Web pages, only to the extent such unlicensed "fair use" is allowed by applicable copyright law. Search Engines are not permitted to query or search information protected by a security verification system ("captcha") which limits access to human users. RoofRay reserves the right to restrict automated queries further, for example, by correspondence to parties making queries or by use of robots.txt.

Materials You Provide; Account Use; Privacy: For materials you post or otherwise provide to RoofRay or in connection with the Services (your "Submission"), you grant RoofRay an irrevocable, perpetual, worldwide license to (1) use, copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, modify, and translate your Submission, in connection with the Services or in any other media, and (2) sublicense these rights, to the maximum extent permitted by applicable law. RoofRay will not pay you for your Submission. RoofRay may remove your Submission at any time. For each Submission, you represent that you have all rights necessary to grant RoofRay the rights in this paragraph and that the Submission complies with Acceptable Use Section above. You may not share your RoofRay user account with others. You are responsible for all actions taken via your account. RoofRay will treat your use of the Services in accordance with its Privacy Policy.

Advertising: RoofRay's business is primarily funded through advertising. You understand and agree that the Services may include advertisements, and that these are necessary to support the Services. To help make the advertisements relevant and useful to you, RoofRay may serve advertisements based on the information we collect from you or in relation to your interaction on our site. See the Privacy Policy for more details.

Installation Services: These terms apply specifically to RoofRay Installation Marketplace:

• RoofRay Installation Marketplace (coming soon): RoofRay allows you to provide anonymous information to installers, integrators, associated financial institutions and their employees (collectively, the "Installers") to request quotes. Installers may elect to respond to your request with non-binding customized quotes of the terms they would offer to a customer matching your anonymous profile, as well as their contact information. These non-binding quotes are not intended to be Good Faith Estimates. If you choose to contact an Installer through RoofRay Installation Marketplace by filling out a contact request form on RoofRay, you authorize RoofRay to provide your name and contact information to the Installer you choose, along with your quote request. By submitting your name and contact information, your identity will no longer be anonymous and Installers may contact you directly. Any installation or other business conducted is between you and the Installers.
• The Role of RoofRay; Disclaimer: RoofRay is not an installer and does not make decisions in connection with installations. RoofRay does not endorse or recommend the products of any particular Installer. RoofRay does not guarantee any specific installation quote and conditions offered to you by a Installer will be granted to you, or that you will be offered any type of package by any Installer. RoofRay is not an agent of either you or any Installer. RoofRay is only providing an administrative service to you and any participating Installers. RoofRay assumes no responsibility for any result or consequence related directly or indirectly to any action or inaction that you take based on the Services, including RoofRay Installation Marketplace, and any other information available there.
• Fees: The RoofRay Installation Marketplace is free to you. Installers participate in this Service, receiving and responding to installation requests, for free. RoofRay does not participate in any installation, and does not receive any fee that depends on which particular Installer you choose. However, RoofRay may charge Installers a one-time fee to apply to join RoofRay Installation Marketplace, an administrative fee for forwarding requests, and Installers may also purchase advertising from RoofRay.
• Participating Installers: The Installers participating on RoofRay are solely responsible for their services to you. You agree that RoofRay shall not be liable for any damages or costs of any type arising out of or in any way connected with your use of the RoofRay Web site, the Installation Services, or the services offered by Installers. RoofRay is not responsible for any errors or delays caused by you or any Installer in the installation process. RoofRay reserves the right, at any time and in its sole discretion, to discontinue, suspend, or terminate the participation of any Installer or other user from RoofRay Installation Marketplace. When an individual Installer applies for RoofRay Installation Marketplace, RoofRay uses commercially reasonable efforts to confirm the Installer’s license (in the states claimed in the Installer’s profile). However, you should confirm credentials yourself if you choose to contact the Installer.
• Privacy: RoofRay will not provide personally identifying information about you to any Installer without your consent. RoofRay may use such information to improve the relevance of advertising shown to you. Please consult the Privacy Policy for more information.

Free Product Rules & Conditions: These terms apply specifically to RoofRay iPod or other product giveaways

1. Requirements
1. User Must:
1. Complete and submit the "Get Free Quote" form from the RoofRay website with valid information in each field.
2. Accept calls from at least two solar installers and allow them to present their information over the phone.
3. Submit a property that is located within the one of the Geographic Eligibility Regions listed below.
2. RoofRay will randomly select one user for every twenty submissions that meet the requirements.

4. Description of Product
1. One 8GB iPod Nano. Color choice may or may not be available. Products may be new or refurbished, but will not be used. Refurbished items will come with complete warranties.
5. Users may only receive on free item.
6. Receipt of Product
1. After a user completes the steps required to receive the product, RoofRay will take measures to ensure that the user receives the product within a reasonable amount of time. Delivery times vary amongst product suppliers, but most products are received within 30 days after random selection.
2. On occasion, products may be back ordered, discontinued from our supplier, or made unavailable. In cases involving backordered products, products will ship as soon as they are made available. In cases involving discontinued and unavailable products, we will provide another similar product of an equivalent value.
3. After a user receives a product, if we determine that he or she fraudulently completed the requirements, we have the right to take legal action against the user.
7. Delivery of Product
1. All orders are mailed to the address provided by the user in the Free Quote Form. It is the user's responsibility to verify that the address provided is correct. RoofRay is not responsible for lost orders stemming from incorrect shipping addresses, theft, or erroneous deliveries. In the event that a situation arises necessitating package forwarding, RoofRay is in no way responsible for ensuring delivery.
2. If a user does not receive a product, he or she should make sure that they have waited the appropriate time period and confirm that the shipping address given is indeed correct. In the event that an item is lost, RoofRay will make a reasonable effort to track the package and replace it if necessary.
3. For any product that has confirmed delivery via a tracking number, RoofRay will not resend the order. If an item is lost, a user can only receive a replacement product. We reserve the right to refuse a replacement order.
4. If a user has received multiple orders at a shipping address, RoofRay has the right, at any time, to refuse future delivery to that address.
8. Return Policy
1. If a product is found to be defective, the user should consult the warranty information included with his or her free item. We are not responsible for the repair or replacement of defective products. Please contact the relevant vendor for questions about damaged or defective products you receive. In cases where you do not know what vendor shipped it to you, we can pass along the appropriate vendor's contact information.
9. RoofRay and the free iPod offer is not affiliated with any of the listed products or retailers. iPod® is a registered trademark of Apple Computer, Inc. All rights reserved. Apple is not a participant of this program.

Software: The Services may include software for use in connection with the Services. If such software is accompanied by an end user license agreement ("EULA"), the terms of the EULA will govern your use of the software. If such software is not accompanied by a EULA, then RoofRay grants to you a non-exclusive, revocable, personal, non-transferable license to use such software solely in connection with the Services and in accordance with these Terms of Use.

Linked Materials: The Services include links to third-party products, services and Web sites. RoofRay does not endorse, and takes no responsibility for such products, services, and Web sites.

Digital Millennium Copyright Act Compliance: RoofRay complies with the provisions of the Digital Millennium Copyright Act (DMCA) applicable to Internet service providers (17 U.S.C, Section 512(c)(2). If you believe that your work has been reproduced on the Services in a way that constitutes copyright infringement you may notify RoofRay's copyright agent by providing the following information:

• An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
• A description of the copyrighted work that you claim has been infringed upon;
• A description of where the material that you claim is infringing is located on the Site;

Changes; Discontinuance: RoofRay reserves the right to change the Terms of Use, and you are responsible for regularly reviewing these Terms of Use. Your continued use of the Services after the effective date of such changes will constitute acceptance of and agreement to any such changes. RoofRay may suspend or discontinue the Services at any time to you and/or to others, without notice.

Choice of Law; Disputes: These Terms of Use are governed by the laws of the State of California, without giving effect to its conflict of laws provisions. You agree to submit to exclusive jurisdiction and venue in the state and federal courts sitting in Contra Costa County, California for any and all disputes, claims and actions arising from or in connection with the Services and/or these Terms of Use. In any dispute arising under this Agreement, the prevailing party will be entitled to attorneys' fees and expenses.

General: You agree not to export from anywhere any part of the Services provided to you or any direct product thereof except in compliance with, and with all licenses and approvals required under, applicable export laws, rules and regulations. All Services used by the US Government are provided with the commercial license rights described herein. If any part of these Terms of Use are determined to be invalid or unenforceable, then the invalid or unenforceable provision will be replaced with a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these Terms of Use will continue in effect. RoofRay may assign this Agreement, in whole or in part, at any time with or without notice to you. You may not assign these Terms of Use, or assign, transfer or sublicense your rights, if any, in the Service. RoofRay's failure to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches. Except as expressly stated herein, these Terms of Use constitute the entire agreement between you and RoofRay with respect to the Services and supersede all prior or contemporaneous communications of any kind between you and RoofRay with respect to the Services.
